Protection against Discrimination based on Sexual Orientation, Gender Identity and Sex Characteristics

The subject of this analysis is to give an overview of the existing laws in the Republic of Macedonia that contain provisions on non-discrimination on different grounds, but omit the grounds of sexual orientation, gender identity and sex characteristics. The aim of this analysis is to point out of the need to amend this set of laws toward their harmonisation with the new Law on Prevention and Protection against Discrimination (which covers the grounds of sexual orientation and gender identity), as well as to more strongly promote the principle of equality and non-discrimination on the ground of sex characteristics which the intersex people are protected against discrimination in the exercise of their human rights with. The analysis has been conducted within the scope of the project “Utilizing EU integration processes for advancing LGBT rights in Western Balkans” by Margarita Tsatsa Nikolovska – Judge and Vice-President at the Constitutional Court of Bosnia and Herzegovina and a former Judge at the European Court of Human Rights in Strasbourg.
